Modern Signal Advisory, LLC (“MSA,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the privacy of individuals and businesses that use MSA’s Platform (as defined in the Terms of Service) through our compliance with this policy. This Privacy Policy explains how we collect, retain, process, disclose, and protect personal data about you when you access our website, create an account, or use any of our products or services, including the website and Platform, and our practices for using, maintaining, protecting, and disclosing that information.

By accessing or using the Platform, or providing us with your information, you agree to the collection and use of information as described in this Privacy Policy. If you do not agree, please do not access or use the Platform. This policy may change from time to time. Your continued use of the Platform after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.

This Privacy Policy is incorporated into and forms part of the MSA Terms of Service. Capitalized terms not defined here have the meanings given in MSA’s Terms of Service.

The policy does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Platform, or by us through any other means, including on any other website operated by MSA or any third part that does not link to this policy.

We retain your personal data for as long as your account is active and for a reasonable period thereafter to comply with our legal obligations, resolve disputes, and enforce our agreements, and for safety, security, and fraud prevention.

MSA implements and uses commercially reasonable administrative, physical, technical, and organizational measures designed to protect your personal data from accidental loss or destruction and unauthorized access, use, disclosure, alteration, or destruction. These measures include encryption of data in transit, access controls, and security monitoring.

No website, mobile application, system, method of transmission over the Internet, electronic storage or online service is completely secure. While we work hard to protect your information, we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Platform. For example, email and chats sent to or from the Platform may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk. Additionally, you are responsible for maintaining the security of your account credentials, for taking steps to protect your personal data against unauthorized use, disclosure, and access, and for notifying us immediately of any suspected unauthorized access.

We will process your request within a reasonable period, subject to our legal obligations to retain certain information (such as records required for tax or fraud prevention purposes).

You may opt out of marketing communications at any time by using the unsubscribe link in any marketing email or by contacting us directly. Opting out of marketing communications does not affect transactional or account-related communications.

6.4 Cookies, Advertising and Other Tracking Technologies Choices

We do not use advertising or behavioral tracking cookies to serve targeted ads on or off the Platform.

Disabling or refusing cookies or similar tracking files may affect the functionality of the Platform. For example, some Platform features may be inaccessible or not function properly. If you block the use of location information, some Platform features may become inaccessible or not function properly.

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

We will work in good faith to honor applicable rights requests.

7. Third-Party Links and Services

The Platform may contain links to third-party websites or reference third-party tools and services (such as Compass, LinkedIn, or Instagram) as part of content publishing guidance. MSA is not responsible for the privacy practices of any third-party site or service. We encourage you to review the privacy policies of any third party you interact with.

8. Minor’s Privacy

The Platform and our services are not directed at or intended for use by individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that we have inadvertently collected or received personal data from a minor under 18 years old, we will delete that information.

9. AI-Generated Content and Data Processing

The Platform uses artificial intelligence models to generate Signal Reports and Signal Voice Content Kits based on your Subscriber Inputs. When you submit inputs to generate content, those inputs are processed by third-party AI infrastructure providers, as previously discussed herein.

We take reasonable steps to minimize the personal data included in AI processing requests. Subscriber Inputs are intended to include market parameters and professional preferences, not personally identifiable information about your clients or third parties. Do not submit identifiable personal data about your clients or prospects as part of your Subscriber Inputs.

MSA does not use your individual Subscriber Inputs or Output Content for the purpose of training or refining AI models on your behalf or for sale to third parties. Aggregated, de-identified usage patterns may be used to improve MSA’s own platform performance and prompt systems.

10. Data Breach Notification

In the event of a data breach that compromises your personal data, MSA will notify affected subscribers in accordance with applicable law, including Florida’s Information Protection Act (Fla. Stat. § 501.171), which requires notification no later than thirty (30) days after the determination of a breach or reason to believe a breach occurred.

Notification will be provided via email to the address associated with your account and, where required by law, to applicable regulatory authorities. The notification will state date, estimated date, or estimated date range of the breach of security, a description of the personal information that was accessed or reasonably believed to be accessed, the steps MSA is taking in response, and information that you can use to inquire about the breach of security and the personal information that we maintained about you.

MSA maintains reasonable security measures to detect and respond to security incidents promptly. In the event of a breach affecting a large number of subscribers, MSA may provide notification through a prominent notice on the Platform in addition to direct email notification.

11. Changes to This Privacy Policy

MSA may update this Privacy Policy at any time at its sole discretion. Material changes will be communicated via email or dashboard notification with reasonable notice before taking effect. Nevertheless, you should check our Platform periodically to see the current policy and any changes we have made to it.

Notices for any other changes to the policy will be provided as required by law, including by updating the “Last Updated” date at the top of this document, which reflects the most recent revision, and posting the updated policy on the Platform. Continued use of the Platform after the effective date of any change constitutes acceptance of the updated Privacy Policy.
